CLOSING IN FOR THE KILL? Lattman’s coverage was tame compared to that of the N.Y. Post’s Mark DeCambre, who attacked the subject like a shark smelling blood. “Flamboyant private-equity honcho Guy Hands admitted yesterday under cross-examination that he couldn't cough up one shred of evidence to support his claim that his private-equity shop Terra Firma was duped by Citigroup,” DeCambre wrote, stating that this admission “could be a key moment in Hands' attempt to win his case.” The reporter then zeroed in one what had to be Hands’ most uncomfortable moment during his seven hours on the stand: “‘Are there any records of the facts…by you or anyone else?’ Wells asked... ‘As you sit on the witness stand, you cannot identify one single piece of paper in the corporate records that reflects that you had a conversation with David Wormsley about his representation that Cerberus was going to bid 262 [pence per share, on Monday, May 21 2007]?’ ‘No, I'm not personally aware of any documents,’ Hands confessed. The quirky Hands, who appeared to have donned the same blue suit and dark blue tie he's been sporting since the trial commenced on Monday, may have lost some credibility.” So what will Hands’ attorney David Boies do to restore his client’s cred?
