A federal judge has just denied a motion for summary judgment by MP3tunes in its court fight against EMI’s Capitol Records. Court documents reveal that his law firm Duane Morris LLP is ducking out of the fight, leaving founder Robertson ordered to find new counsel by Sept. 7. "MP3tunes filed for bankruptcy and was unable to pay them," Robertson told Digital Music News. "This is the outcome when a major international corporation spends $10 million on a legal assault over five years. No small company can withstand the onslaught." No kidding. (7/24a)
