KOVAC FOR THE DEFENSE: Allen Kovac’s lawyer Skip Miller clarifies last week’s report that Dina LaPolt won a motion on three of Kovac's claims against her regarding the alleged mismanagement of Steven Tyler's career, specifically the amount negotiated for him to appear as a judge on American Idol. Miller insists the Court left in the case all claims against LaPolt arising from her interference and disruption of Motley Crue, merely asking 10th Street to quantify its damages. The Court also left in the case the claim for interference and damages in connection with Tyler. Finally, as reported, the Court did indeed dismiss the claim arising from the American Idol/Tyler negotiations based on the California SLAPP statute, saying the negotiations were subject to First Amendment protection. Miller argues, as these were private contract negotiations by an attorney, LaPolt breached her fiduciary duty, and is trying to do so by “hiding behind the First Amendment.” To be continued.
