SURVIVOR [THE GROUP] HAS ISSUES WITH TV PROGRAM
Guess the “Eye of the Tiger” finally opened up and is ready to litigate. A founder of the Grammy-winning band Survivor will take legal action to prevent the band's name from being used on a soon-to-be-released soundtrack from the widely popular “Survivor” TV series. Lead guitarist Franklin Sullivan III, who trademarked the name Survivor in 1977, will ask a federal court in Chicago next month for a preliminary injunction against CBS and TVT Records, lawyer Annette McGarry said. “After 23 years of selling and performing music in the marketplace, Sullivan has rights to the famous trademark, ‘Survivor.' We are confident that Sullivan will be the ultimate winner,'' she added. “This is the first time the public has said ‘Survivor' since Rocky III.”

GRAMMY'S TAP LOPEZ, ESTEFAN, SMITS, GARCIA
Singer-actress Jennifer Lopez has signed on to co-host the inaugural Latin Grammy Awards with Gloria Estefan and actors Andy Garcia and Jimmy Smits. Along with hosting, Lopez and Estefan will also perform on the show, which will be telecast live on Sept. 13 from the Staples Center in Los Angeles on CBS. Lopez declined to comment on reports that her boyfriend, Sean “Puffy” Combs, told producers that Lopez needs to have plenty of air time or he would have someone bust a cap in their asses.

OSBORNE PREPS ALBUM, TOUR
If God was one of us, wouldn't he have forced Joan Osborne to put a new record out sooner? It's been five years since her debut album, “Relish,” but Osborne's new record on Interscope, called “Righteous Love,” is due to hit stores Sept. 12. Her tour kicks off Sept. 1 at the New York State Fair in Syracuse, where she'll open for Live before traveling cross-country to appear at the Bumbershoot Festival in Seattle Sept. 4. “I can't believe music went on without her,” an executive said. “We should welcome her with open arms!”

WYNONNA GARAGE SALE- HER BIGGEST HIT
Fans have had a field day at country music star Wynonna Judd's garage sale. A steady stream of cars Friday trickled in and out of Judd's Nashville estate. “She's sold the house and is building her dream house on 500 acres she owns next to where her mother and sister live,'' said Kerry Hansen, Wynonna's spokeswoman. “Meanwhile, she'll be living in a smaller house that has no room for most of this stuff.'' Among the items for sale were stage clothing, shoes, books, furniture, Christmas decorations, household appliances, memorabilia and hotly pursued nude photos of sister Ashley.

EX-ALLMAN BROTHERS BASSIST FOUND DEAD
Douglas Allen Woody
,a former bassist for the Allman Brothers Band, was found dead Saturday morning dead in a New York City motel. The cause of death is unknown, there were no visible signs of trauma according to police. He joined the Brothers in 1989, leaving in 1997 with Warren Haynes to form Gov't Mule.

MADONNA IS NUMBER ONE WITH A BONNET
The first single and title track from Madonna's upcoming record, “Music,” entered the charts at number one in Britain on Sunday (8/27). It's the Mother of the Year candidate's 10th top single in the country that gave the singer her latest accent. The album comes out Sept. 19.
