In his suit, filed in August 1999, Ricardo Macchi claimed that Jackson had a hepatitis B vaccine, an anti-depressant and an appetite suppressant all prescribed under his name in order to maintain her privacy. Jackson's estranged husband, Rene Elizondo Jr., two doctors and Jackson's business corporation were also named in the suit.
Macchi had asked that the defendants be prohibited from using his name and that he be awarded damages commensurate to the fees paid to the doctors to write the prescriptions. He also sought restitution for the value of his name.
But Thursday, Judge Alexander Williams said Macchi failed to provide proof that he'd suffered damages from the alleged use of his name.
